Description:"This Environmental Assessment (EA) evaluates potential environmental impacts associated with a National Marine Fisheries Service (NMFS) proposed rule under the Marine Mammal Protection Act (MMPA) of 1972 to modify the regulations implementing the Harbor Porpoise Take Reduction Plan (HPTRP) to reduce serious injury and incidental mortality of the Gulf of Maine/Bay of Fundy (GOM/BOF) stock of harbor porpoises (Phocoena phocoena) in Northeast and Mid-Atlantic Category I commercial gillnet fisheries. The following general requirements are proposed as described in Alternative 4 (Preferred): the expansion of the management areas and seasons in New England in which pingers are required, the establishment of 'consequence closure areas' in New England which will close if bycatch rates over two consecutive years indicate that harbor porpoise takes are greater than a specified target bycatch rate, the addition of a management area in which additional gear restrictions and a closure period are proposed within the Waters off New Jersey Management Area in the Mid-Atlantic, and a gear modification change requested by Mid-Atlantic gillnet fishermen"--Introduction.
