Description:California’s Central Valley (CV) spring-run Chinook salmon (Oncorhynchus tshawytscha) are listed as threatened under the Federal Endangered Species Act (ESA). CV spring-run Chinook salmon were extirpated from the upper Yuba River following construction of Englebright Dam, which blocked access to historical holding, spawning and rearing habitats. Reintroduction of CV spring-run Chinook salmon to historical but currently inaccessible high-quality habitats is a high priority in the National Marine Fisheries Service’s (NMFS) 2014 recovery plan for CV salmon and steelhead. Although a reintroduction plan has not been finalized, reintroduction to the upper Yuba River has been in the developmental stage for at least 20 years. In order to catalyze ongoing and future reintroduction efforts, NMFS proposed a rule under ESA section 10(j) to provide regulatory assurances for landowners and other user groups when CV spring-run Chinook salmon are ultimately released into the upper Yuba River watershed. NMFS published a proposed rule and notice of availability for the draft Environmental Assessment (EA) in the Federal Register on December 11, 2020 (85 Fed. Reg. 79980) for the designation of a nonessential experimental population of CV Spring-run Chinook Salmon in the upper Yuba River upstream of Englebright Dam. The nonessential experimental population designation boundary extends from Englebright Dam to the ridgeline of the Yuba River watershed in the Sierra-Nevada Mountains in northern California. This final EA addresses NMFS’ issuance of a final rule to designate CV spring-run Chinook salmon in the upper Yuba River watershed as a nonessential experimental population.
