Description:On November 7, 1996, NOAA and EPA issued an Environmental Assessment (EA) and Finding of No Significant Impact (FONSI) for the approval, with conditions, of Michigan’s coastal nonpoint program for public comment (61 FR 57673). On October 31, 1997, NOAA and EPA approved the Michigan coastal nonpoint program, with conditions (62 FR 58940). Since that time, Michigan has undertaken a number of actions to address each of the identified conditions. Based on those actions and the materials provided by the State that document how its program meets each condition, on May 11, 2023, NOAA and EPA published a notice and request for public comment on the proposed finding that Michigan has satisfied all conditions of approvability on its coastal nonpoint program (88 FR 30280). This analysis document examines whether supplemental environmental review under NEPA is required prior to NOAA and USEPA making its decision on whether to approve in full Michigan’s coastal nonpoint program.
