The purpose of this study is to help Rhode Island fishermen understand what activities are permitted under Rhode Island Department of Environmental Management’s (RIDEM) Direct Sale Dealer License (DSDL). RIDEM regulations prohibit fishermen1 with a DSDL license from “processing” fish, but RIDEM defines this term only by reference to Department of Health regulations, and its scope may be uncertain in this context. In addition, some stakeholders have questioned whether Rhode Island agencies can allow processing by DSDL licensees, including to allow licensees to hold fish overnight prior to retail sales. This document explains the meaning of “processing” in the context of the DSDL program and state authority to allow practices included in that definition.
