Description:Gulf of Mexico Bryde's whales were proposed to be listed as endangered on December 8, 2016. If the proposed listing becomes final, all of the take prohibitions of section 9(a)(1) of the ESA would apply once the species is listed. These include prohibitions against the import, export, use in foreign commerce, or 'take' of the species. These prohibitions apply to all persons subject to the jurisdiction of the United States, including in the United States or on the high seas. Ongoing research or other activities that may affect this proposed species will require a reinitiation of ESA section 7 consultation. The action agencies for the permitting and research actions considered in this consultation, were proactive in seeking to conference with NMFS on their activities based on the proposed listing of Gulf of Mexico Bryde's whale as endangered under the ESA. In this opinion, we have batched a number of consultation together because of the similarity of actions, and likely effects of those actions on ESA-listed species and designated critical habitat, and the reinitiation trigger of the proposed listing of Gulf of Mexico Bryde's whale.--Page 2.
