Description:The action agency for this consultation is the NMFS Office of Protected Resources (NMFS OPR) Permits and Conservation Division (hereafter referred to as 'the Permits Division') for its issuance of a scientific research and enhancement of propagation or survival permit pursuant to section 10(a)(1)(A) of the ESA and the NMFS OPR Marine Mammal Health and Stranding Response Program (hereafter referred to as 'the MMHSRP' or 'the Program') pursuant to sections 104c, 109(h), 112(c) and Title IV of the Marine Mammal Protection Act (MMPA). Consultation in accordance with section 7(a)(2) of the statute (16 USC 1536 (a)(2)), associated implementing regulations (50 CFR. ʹ402), and agency policy and guidance (USFWS and NMFS 1998a) was conducted by the NMFS OPR's ESA Interagency Cooperation Division (hereafter referred to as 'we'). This biological opinion (opinion) and incidental take statement were prepared by the NMFS OPR's ESA Interagency Cooperation Division in accordance with section 7(b) of the ESA and implementing regulations at 50 CFR ʹ402. This document represents the NMFS' opinion on the effects of these actions on endangered and threatened species and designated critical habitat for those species--Pages 1-2.
