Description:For the actions described in this document, the action agency is NMFS' Office of Protected Resources - Permits, Conservation and Education Division. The consulting agency is NMFS' Office of Protected Resources - Endangered Species Division. pursuant to the Marine Mammal Protection Act (MMP A), NMFS' Office of Protected Resources - Pennits, Conservation and Education Division proposes to issue a pennit for direct 'takes' of endangered spenn (Physeter macrocephalus), blue (Balaenoptera musculus) and fin whales (Balaenoptera physalus) within the U.S. Navy's existing Southern California (SOCAL) Range Complex, other US locations including offshore waters and international waters throughout the Pacific basin. This permit would also authorize 'takes' of nontarget endangered humpback (Megaptera novaeangliae) and sei 2 whales (Balaenoptera borealis) as well as threatened Guadalupe fur seals (Macrocephalus townsendi) pursuant to the MMPA and the Endangered Species Act (ESA). This ESA Section 7 consultation (Opinion) considers the effects of the proposed studies on endangered and threatened species and designated critical habitat--[Page 2].
