Description:"The Gulf of Mexico gray triggerfish stock was determined to be overfished and undergoing overfishing based on the results of the 2011 update stock assessment. Currently, the Gulf of Mexico Fishery Management Council (Council) is developing Amendment 37 to the subject FMP to develop long-term measures to end overfishing and rebuild the stock. However, management measures proposed in this amendment will not be ready for implementation in the near future. Therefore, the Council recommended at its February 2012 meeting that NOAA Fisheries Service develop an interim rule to reduce overfishing in 2012 until measures from Amendment 37 are effective. The interim rule would reduce the current commercial and recreational ACLs from 138,000 and 457,000 pounds whole weight (ww) to 64,100 and 241,200 pounds ww, respectively. The rule also applies the Council's ACU/ACT control rule to set the ACTs. The commercial ACT would be set at 60,900 pounds ww and the recreational ACT at 217, 100 pounds ww. There is no in-season mechanism to close the recreational sector if it exceeds its ACL. The commercial sector has a quota closure where the sector closes if the ACT is harvested. Because of concern that the recreational sector will likely exceed its ACL if the harvest is not controlled, the rule would establish an in-season recreational AM.
