- This amendment document and environmental assessment (EA) present and evaluate management alternatives and measures to achieve specific goals and objectives for the scup fishery (section 4.0). This document was prepared by the Mid-Atlantic Fishery Management Council in consultation with the National Marine Fisheries Service (NMFS). This amendment is being developed in accordance with the Magnuson-Stevens Fishery Conservation and Management Act1 (MSFCMA, M-S Act) and the National Environmental Policy Act (NEPA), the former being the primary domestic legislation governing fisheries management in the U.S. Exclusive Economic Zone (EEZ). In 1996, Congress passed the Sustainable Fisheries Act (SFA), which amended and reauthorized the MSFCMA and included a new emphasis on precautionary fisheries management. New provisions mandated by the SF A require managers to end overfishing and rebuild overfished fisheries within specified time frames. Most recently, the Magnuson-Stevens Fishery Conservation and Management Reauthorization Act of 2006 was passed by Congress. 1
- This document describes the plan of the North Pacific Fishery Management Council (Council) for managing the salmon fisheries in the U.S. Exclusive Economic Zone (EEZ or Federal waters) off the coast of Alaska. It replaces the Council's existing plan, developed during 1977 and 1978 and amended in 1980 and 1981. 1
- This framework adjustment to the Summer Flounder, Scup, and Black Sea Bass Fishery Management Plan was prepared by the Mid-Atlantic Fishery Management Council and is intended to improve management of the scup commercial fishery, pursuant to the MagnusonStevens Fishery Conservation and Management Act of 1976, as amended by the Sustainable Fisheries Act (SFA) in 1996. 2

- Under section 302(h) of the Magnuson-Stevens Act, as amended by the SF A, Regional Fishery Management Councils (Councils) prepare and submit Fishery Management Plans (FMPs) for fisheries under their authority that require conservation and management. The summer flounder (Paralichthys dentatus) fishery is managed under the Summer Flounder, Scup and Black Sea Bass FMP that was prepared cooperatively by the Council and the Atlantic States Marine Fisheries Commission (Commission). Amendment 12 to the FMP added a framework adjustment procedure that allows the Council to add or modify management measures through a streamlined public review process. The action proposed in this document would modify the existing Summer Flounder, Scup and Black Sea Bass FMP via this framework adjustment process. 1
